La operatividad de la inteligencia artificial aplicada a las resoluciones judiciales

Abstract

La información posee un gran valor en la actualidad, esta se ha revalorizado en gran parte debido a que en toda acción jurídica se desenvuelve un proceso informativo desconocido hasta ahora. Lo que hace que la comunicación relativa a los instrumentos de producción y difusión normativa sea el punto central en el que nos tenemos que fijar. Dentro de este marco, la inteligencia artificial y su utilización por los operadores jurídicos ha modificado la estructura del Derecho y los estándares clásicos. En concreto, ha planteado encendidos debates entre sus detractores y defensores, quedando claro que se han de fijar unos límites de lo que puede llegar a hacer dicha inteligencia artificial y lo que está reservado a lo humano. En medio de este contexto, se aprecia que la informática y la lógica jurídicas llevan a cabo un importante papel instrumental, y ello hace que no se deban obviar bajo ninguna circunstancia. Finalmente, se llega a la conclusión de que necesitamos jueces que se encarguen de juzgar y hacer ejecutar lo juzgado, debiendo ser, a su vez, técnicos que reúnan una buena formación teórica y cualidades que mantengan un equilibrio entre autoridad y comprensión.
