La Consulta Popular, una Herramienta para Limitar la Explotación Minera

Abstract

El ensayo analiza la figura de consulta popular en el régimen ecuatoriano. Primero se contextualiza la relación entre ambientalismo y minería, para luego pasar a la discusión central. Los requisitos que una propuesta de consulta popular debe superar para que efectivamente se lleve a cabo, con el objetivo de limitar la minería cercana a fuentes hídricas. Se señala al control constitucional como el requisito mas exhaustivo y dentro de esto se trata las ambigüedades sobre el control formal y material. Para esto se realiza un análisis a los dictámenes mas recientes de la Corte Constitucional sobre el tema. Adicionalmente se debate si los requisitos que exige el control pueden ser una limitante al derecho de participación ciudadana y como lograr un balance. Se concluye con la afirmación de la posibilidad de aplicar una consulta popular para limitar la minería cercana a fuentes hídricas, sin embargo, se destaca los obstáculos existentes.
