Análisis de la Problemática Jurídica del Hábeas Corpus en el Caso Talavera: ¿Desconocimiento, Inobservancia o Discrecionalidad?

Abstract

El presente trabajo investigativo analizó la figura del hábeas corpus en el caso de Jorge Ordóñez Talavera, una persona privada de libertad que fue objeto de tratos degradantes a consecuencia de un amotinamiento carcelario. En el análisis se utilizó la metodología cualitativa y crítica considerando normas y precedentes jurisprudenciales de la Corte Constitucional, obteniendo como resultado a la problemática jurídica expuesta, un hilo secuencial en el que los jueces desconocieron el alcance de protección del hábeas corpus, que conllevó al cometimiento de inobservancias legales, y la emisión de dictámenes discrecionales que incumplieron con el derecho al debido proceso. Además, mediante un método de interpretación teleológico se determinó que la Corte Constitucional incurrió en una inobservancia jurisprudencial que derivó en una decisión discrecional, al otorgar medidas alternativas a la privación de libertad, omitiendo el hecho de que elprivado de libertad tenía sentencia ejecutoriada por el delito de asesinato.
