Temas regulatorios y factores impulsores de los activos digitales ambientales

Abstract

Los Activos Digitales Ambientales (ADA) se han consolidado como herramientas esenciales en la gestión sostenible y la conservación ambiental. Conforme crece la preocupación por el medio ambiente, los ADA, apoyados en tecnologías digitales, se están utilizando ampliamente como mecanismos instituciona-les contra el cambio climático. A nivel internacional, vemos un crecimiento en la regulación de los ADA, pero con un fraccionamiento considerable, evolucionando según surgen distintos “casos de uso” y problemáticas derivadas de su naturaleza intangible. La digitalización de recursos ambientales plantea interrogantes jurídicos: definir su naturaleza, determinar las condiciones para su titularidad y explorar las posibilidades de comercialización en mercados digitales. Además, es crucial considerar políticas de fomento para estos activos, como promover la energía limpia y establecer criterios de verificación y auditoría. Este informe contempla hacer un mapeo de los temas regulatorios de los ADAs en el mundo y hacer recomendaciones a cómo hacerlos adecuados y eficientes.
