Abstract

La Constitución del año 2008 de Ecuador, por primera vez en el constitucionalismo global, reconoció que la naturaleza es sujeto y que tiene derechos específicos. La aplicación de estos derechos ha requerido tiempo y ha sido lento. Esta situación se explica, en parte, por una cultura jurídica que considera a la naturaleza como propiedad privada, por la ausencia de una teoría jurídica que compatibilice el derecho de los humanos con el derecho de la naturaleza y por la falta de diálogo del derecho con otras disciplinas que estudian la naturaleza. El derecho que reconozca que la naturaleza tiene vida, que hay que respetar y entender desde otras disciplinas, podría denominarse derecho sistémico. Con una mirada sistémica, la Corte Constitucional del Ecuador ha podido desarrollar el contenido y alcance de los derechos de la naturaleza en casos relacionados con manglares, bosques, ríos, animales silvestres. En esta época de crisis ambiental y cambio climático, reconocer que la naturaleza tiene derechos es una forma de cambiar radicalmente el paradigma jurídico y político dominante para proteger y restaurar la naturaleza.
