Reconfigurando la libertad de pensamiento ante el impacto de las neurotecnologías

Abstract

El artículo analiza la necesaria reconfiguración de la libertad de pensamiento ante el avance de las neurotecnologías que han superado la concepción de la mente como un reducto inviolable. Partiendo del debate sobre los neuroderechos y su evolución desde la libertad cognitiva hacia una interpretación adaptativa de la libertad de pensamiento reconocida en los tratados internacionales, se abordan su naturaleza absoluta y sus garantías negativas frente a la revelación, la penalización y la alteración del pensamiento. Desde ese marco se examinan las teorías del umbral y el enfoque cuasiabsoluto para evaluar los criterios de admisibilidad de las excepciones o limitations, proponiendo reafirmar su estatus absoluto interpretándolo como primacía axiológica y presunción iuris tantum de ilegitimidad de intervenciones.
