Enriquecimiento injusto ante las consecuencias de la contratación irregular

Abstract

Es una realidad que, en ocasiones, la Administración recibe prestaciones de los empresarios sobre la base de contratos irregulares, en algunos casos incluso sin contrato previo o de referencia. Se trata de un tema recurrente en el que la ilegalidad no puede ocultar el beneficio obtenido por aquella y su obligada compensación. Para afrontar el pago de esas prestaciones se han utilizado diversas vías, tales como el enriquecimiento injusto, la revisión de oficio, la responsabilidad contractual y también la extracontractual. Todas esas vías han acabado siendo cuestionadas por los órganos consultivos y de fiscalización, tildadas de excepcionales o fraudulentas. Es más, en los últimos años se viene trasladando la responsabilidad al empresario, al que se achaca la culpa de la existencia de aquellas contrataciones ilegales. Se utiliza para ello la figura del contrato inexistente, aunque olvidando el carácter garantista inherente a esta categoría jurídica y sin atender los problemas estructurales que provocan. Sin embargo, el problema sigue existiendo porque la Administración tiene el deber de satisfacer las necesidades colectivas de los ciudadanos, lo que, cuando se producen estas situaciones, suscita el conflicto entre el cumplimiento de la legalidad y la atención de esas necesidades. Sin perjuicio de la depuración de las responsabilidades en que pudiera incurrir tanto la Administración como el empresario, tras analizar todas las vías planteadas, el presente estudio vuelve nuevamente hacia el enriquecimiento injusto como la fórmula más adecuada para resolver las consecuencias patrimoniales de la contratación irregular. la contratación administrativa irregular.
