Causas de nulidad procesal: una revisión de la teoría de las identidades en el orden contencioso-administrativo

Abstract

Varios supuestos de inadmisión de actos procesales de las partes y nulidad de actuaciones judiciales por motivos formales se articulan en torno a la identidad de la pretensión como objeto del litigio, bien para que no se repita un segundo proceso idéntico (acto confirmatorio, litispendencia y cosa juzgada material, según que el primer proceso no se haya iniciado con consentimiento del acto, esté en tramitación o concluido con sentencia firme sobre el fondo), bien para que no se altere dicho objeto dentro del mismo proceso (desviación procesal respecto a la vía administrativa, a lo largo de la causa o por el dictado de una sentencia incongruente). Siendo la teoría civilista de las identidades, integrada con las singularidades del objeto contencioso, la que fija la extensión de esa identidad a los efectos de todas estas instituciones hilvanadas por la jurisprudencia. Extensión que sigue reclamando una clarificación coral y singular para que los óbices procesales, además de responder a sus objetivos parciales en contra de la duplicidad y desviación, obedezcan a la interpretación más completa y equilibrada de la tutela judicial.
