Abstract

La Sentencia del Tribunal Supremo 2797/2017, Sala Tercera, Sección Tercera, de 21 de junio de 2017 ha planteado un importante problema jurídico, no solo de mucha relevancia en el presente, sino de gran proyección hacia el futuro. La impugnación de la reforma operada en el sector eléctrico por el Gobierno español en el periodo 2013-2014, reiteradamente confirmada por el Tribunal Supremo en numerosísimas sentencias, se ha encontrado ahora con un nuevo interrogante: la posible eficacia de un Laudo arbitral del CIADI (de 4 de mayo de 2017) condenatorio para el Estado español, y que mantiene una tesis abiertamente contraria a la defendida por la propia jurisprudencia del Tribunal Supremo. En el presente trabajo proponemos algunas reflexiones sobre las posibilidades existentes para dar alguna clase de aplicación al citado laudo.
