Abstract

La primera ley estatal de vivienda en democracia se ha aprobado finalmente en un contexto en el que las políticas de vivienda multinivel no han conseguido solucionar el laberinto del acceso a una vivienda desde el estallido de la crisis financiera internacional en 2008. Al contrario, la obligación de proveer a los ciudadanos de una vivienda digna y adecuada se ha ido delegando progresivamente a los propietarios privados sobre la base de la función social de la propiedad, quienes se ven expuestos a sanciones, expropiaciones, impuestos y otras obligaciones. El presente artículo analiza la regulación del derecho de propiedad privada en la Constitución española y cómo la función social de la propiedad, en conexión con el derecho a una vivienda digna y adecuada y la vertiente institucional del derecho de propiedad, ha sido la base para la configuración de una concepción estatutaria de la propiedad de una vivienda sustraída del régimen general del Código Civil español que ha cristalizado en ley estatal por el derecho a la vivienda. Se concluye sobre lo que ello representa para la libertad individual, la democracia y la propiedad como principal activo económico de los ciudadanos.
