La Suprema Corte Mexicana y la justiciabilidad de los mensajes estigmatizantes

Abstract

El trabajo tiene como objetivo analizar la sentencia dictada por la Primera Sala de la Suprema Corte de Justicia mexicana en el amparo en revisión 152/2013 en la que se declaró la inconstitucionalidad de la exclusión de los homosexuales del régimen matrimonial en el Estado de Oaxaca.1 Esta sentencia refleja un cambio importante en la forma de entender el interés legítimo tratándose de la impugnación de normas autoaplicativas (es decir, de normas que causan perjuicio sin que medie acto de aplicación), dando paso a la justiciabilidad de los mensajes estigmatizantes. En el caso, esta forma más amplia de entender el interés legítimo está basada en la percepción de que el derecho discrimina a través de los mensajes que transmite; situación que la Suprema Corte considera puede combatir a través de sus sentencias de amparo. Asimismo, se plantean algunos retos e inquietudes que suscita la sentencia a la luz del activismo judicial que puede conllevar.
