Abstract

Der Beitrag gibt aus rechtshistorischer Perspektive einen Überblick über Grundfragen von Rechtsvielfalt in verschiedenen Epochen der europäischen und deutschen Rechtsgeschichte. Es geht zum einen um eine Art Bestandsaufnahme, nämlich um verschiedene Erscheinungsformen von rechtlicher Vielfalt in verschiedenen Gesellschaften und Rechtskulturen. Zum anderen zeigen historische Beispiele, welche historischen Lösungsmöglichkeiten es gab, Vielfalt zu beseitigen oder in der Praxis handhabbar zu machen. Zentrale Weichenstellungen wie das Personalitäts- und Territorialitätsprinzip, die Kodifikationsbewegung, aber auch die Prägekraft einer selbstbewussten Rechtswissenschaft kommen zur Sprache. Der Beitrag geht auf einen Vortrag zurück, der ursprünglich an Historiker des Konstanzer Arbeitskreises gerichtet war und vor allem Anknüpfungspunkte für frühmittelalterliche und hochmittelalterliche Fragestellungen bieten sollte. Die deutsche Originalfassung erscheint in den „Vorträgen und Forschungen“: Stefan Esders, Karl Ubl (Hrsg.): Kollision und Interferenz normativer Ordnungen im frühen und hohen Mittelalter (im Erscheinen).

The article provides an overview of basic questions of legal pluralism in various epochs of European and German history from a legal-historical perspective. It presents different manifestations of legal diversity in different societies and legal cultures. Additionally, historical examples show which historical solutions existed to eliminate diversity or to make it manageable in practice. Central developments and turning points such as the principles of personality and territoriality, the movement towards codification, but also the formative power of a self-confident jurisprudence are discussed. The paper is the revised version of a lecture originally given to historians of the "Konstanzer Arbeitskreis" and was originally intended to address questions regarding the early and high Middle Ages. The original German version appears in "Vorträge und Forschungen": Stefan Esders, Karl Ubl (Ed.): Kollision und Interferenz normativer Ordnungen im frühen und hohen Mittelalter (forthcoming).
