Los “derechos consulares” de los extranjeros detenidos: ¿Nuevas cartas en la baraja de los derechos fundamentales?

Abstract

El art. 36.1.b) de la Convención de Viena de Relaciones Consulares de 1963 establece los que llamamos en este trabajo “derechos consulares” de los detenidos en el extranjero. Durante décadas no fue objeto de especial atención a pesar de que se adoptó in extremis en la conferencia internacional de 1963, subrayando su naturaleza de desarrollo progresivo tanto entonces como ahora. En los últimos veinte años, varios pronunciamientos judiciales internacionales (de tribunales diversos: Corte Interamericana de Derechos Humanos, la Corte Internacional de Justicia y el Tribunal Europeo de Derechos Humanos) han suscitado, entre otras cuestiones, la conexión de estos derechos con el derecho a la libertad así como con el derecho a un juicio justo y las garantías de la defensa como derechos humanos. Además, los “derechos consulares” han sido objeto de desarrollo normativo en el ámbito regional europeo. Por ello, hemos considerado de interés hacer un análisis del status quo en la Unión Europea y España. Este trabajo analiza también la normativa interna española sobre los supuestos de detención no penal, que suelen ser obviados en los estudios sobre asistencia consular. Con todo ello, propondremos una valoración final sobre la naturaleza de los derechos consulares y sus consecuencias en la actualidad.
