Abstract

Dadas las nefastas cifras entorno a la calidad del medioambiente y las preocupaciones expuestas frente a su conservación, se busca desarrollar claridades desde una postura jurídica, que permiten reconocer al medio como potencia sujeto de derechos desde la perspectiva de la bioética, ampliando en este sentido las posibilidades de protección. El medioambiente como ser vivo, del cual el ser humano hace parte, sobre el cual se materializa la justicia social de rol, al concebirle como minoría que requiere, los documentos que se presentan a continuación derivan de ejercicios investigativos que desde la doctrina jurídica pretenden justificar las posturas del medioambiente como sujeto de derecho: evolucionando jurídicamente desde el antropocentrismo, hasta el ecocentrismo como evidencias claras de una conciencia ecología que exige posicionamiento. Como establece la carta de la tierra, el hombre es un ser parte del medioambiente, y si bien debemos garantizarle su calidad de vida, con mayor razón se debe asegurar protección al que provee dicho bienestar, y así lograr un desarrollo sostenible.
