Neurotecnologie e neurodiritti digitali: la privacy mentale

Abstract

L’uso terapeutico e riabilitativo delle neurotecnologie nei confronti di patologie invalidanti per le quali i comuni trattamenti sono parzialmente o completamente inefficaci si sta sviluppando sempre più rapidamente. Sono ormai realtà progetti per l’installazione di interfacce cervello-computer in grado di potenziare le percezioni, salvare i ricordi, amplificarli e cancellarli in maniera selettiva. Il dominio mentale, da sempre considerato la sfera privata per antonomasia, l’ultimo territorio inaccessibile anche all’intrusività dilagante del “datismo”, è in serio pericolo. Le implicazioni etiche di tali possibili derive non sono affrontabili dalle protezioni e dalle regole esistenti. Sono necessari nuovi diritti specifici per il dominio neurale, veri e propri neurodiritti, per definire e realizzare la portata del cambiamento, una delle più grandi sfide della nostra epoca, in modo eticamente e socialmente condivisibile, allo scopo di non permettere di violare l’ultimo baluardo dell’identità soggettiva dell’uomo, la privacy mentale.
