Abstract

Bilindiği üzere Hanefî fakihler, yöntemlerinin meşruiyetini sağlayabilmek için başta Kur’an olmak üzere pek çok delile başvurmuştur. Bu çalışmada da Hanefî fa-kihlerinin fıkıh usulünü temellendirirken referansta bulunduğu söz konusu ayetlerden bazıları incelenecektir. Böylece bu mezhebin Kur’an anlayışı ve yorum yöntemi hakkında da bilgi verilmiş olacaktır. Bize göre Hanefî fakihleri, en temel ve tartışmasız kaynak olan kitap ve sünnet gibi şer’î delillerin meşruiyetini de Kur’anî delillerle desteklemek istemişlerdir. Bu da Kur’an’m gerek metinsel gerekse tarihî bağlam dikkate alınmadan, lafzın esas alınarak yorumlanmasına neden olmuştur
