Abstract

En la realidad juridica existente en un proceso, salvo las excepciones del caso, se requiere la existencia efectiva y fisica deldemandado, quien si por alguna circunstancia no puede o no quiere concurrir a ese escenario -como es el proceso- se debe,bajo instituciones constitucionales y legales, suplirse en mandatarios designados por el Juez para velar por el debido procesoy cumplir con uno de los tantos actos, como es trabar la Litis y ejercer el derecho de defensa ante las postulaciones expresadaspor el demandante y de esta manera proseguir con las otras etapas demostrativas y resolutivas que enmarcan el proceso.En este articulo de reflexion se analiza justamente esa delegacion que hace el Juez, en otra persona distinta al demandadoen rebeldia o en incapacidad para comparecer, para mostrar como no se esta cumpliendo con la verdadera finalidad quebusca esa delegcion muy a pesar de las reformas procesales que se han dado en lo referente a la figura y sobre quien recaeesta defensa; por constituirse dichos patrones, en una herramienta mas para llenar un vacio del que esta ausente y no parala proteccion de sus derechos y de esta forma poder garantizar una tutela y una igualdad entre las partes que concurrenal proceso. Constituyendose por lo tanto en un instrumento aunque obligatorio, carente de defensa tecnica y revestido deparcialidad, ante las disposiciones de la legislacion actual y las reformas traidas por el Codigo General del Proceso.
