Abstract

Una Respuesta de la Signatura Apostólica recordaba que la pericia es medio de prueba imprescindible para declarar la nulidad por incapacidad, salvo que aparezca evidentemente inútil (cc. 1095 y 1680). Cuando el perito no pueda examinar al sujeto (frecuentemente porque este se niega) basará su dictamen en los datos, sobre todo de carácter médico, que encuentre en los autos. La obtención de este tipo de datos sin o contra el querer del interesado es problemática; en Italia existe jurisprudencia civil que ordena facilitar esos datos cuando está en juego la defensa de derechos del mismo rango que la intimidad. Aunque su valor como medio de prueba sea objetivamente más limitado que el de la pericia ordinaria, en la práctica depende de los datos fiables que resulten del sumario. Siendo distintos los ámbitos de competencia científica de juez y perito, el diálogo entre ambos –necesariamente crítico por parte del juez– deberá buscar un terreno común, donde cabe bien el conocimiento que cada uno posea de la materia del otro.
