Unión y convivencia familiar: protección de la familia por los Comités de NNUU

Abstract

Family union and coexistence, a legal good protected by international Instruments and national law, is subject to greater risk due to current social circumstances that influence family stability. Sometimes the risk comes from interference by public authorities. In these pages we analyze the standards for the protection of family union established by the Human Rights Committee and the Committee on the Rights of the Child in their General Observations and Views. We understand that States that have ratified the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, and have recognized the competencies of their Committees, should adapt their domestic legislation to these standards in the interests of greater protection of the family, a fundamental element for society. However, the analysis of reality shows us that we are far from this objective.
