La expansión urbana como centro de tensión entre la normativa liberalizadora y la planificación urbana en Perú (1995-2019)

Abstract

El presente trabajo de reflexión ha sido motivado por el insostenible e ineficiente crecimiento de las ciudades peruanas que se expresan en el consumo irracional del suelo —recurso natural, escaso y no renovable—, una dosis alta de dispersión con densidades bajas y en desmedro de la ancestral vocación agrícola que caracteriza sus entornos. Versa en el análisis diacrónico de los dispositivos más relevantes que en materia de expansión urbana e intangibilidad de tierras agrícolas periféricas han venido rigiendo en Perú desde la centuria pasada, con el propósito de evidenciar la antinomia existente entre la Ley 26505 (1995) —dispositivo que liberaliza el uso del suelo, al eliminar la intangibilidad de tierras agrícolas periféricas— y la planificación urbana —cuyo fin es el de regir adecuadamente el crecimiento de las urbes—, y proponer un ajuste jurídico que conlleve a superar dicha contradicción; además de coadyuvar a la consolidación del derecho urbanístico peruano. Para el efecto, se recurrió a la investigación documental, la cual privilegió la información contenida en diversos dispositivos, sistematizando su estudio desde una perspectiva diacrónica. Efectuada la investigación, se concluye efectivamente que la Ley en cuestión colisiona con la dimensión normativa de los planes urbanos, y para superar esta divergencia la reflexión llega a plantear el ajuste jurídico pertinente, de modo tal que la normativa que regula el uso de las tierras agrícolas armonice con aquella que emana de los planes urbanos.
