La prueba del dolor físico en el derecho procesal: una mirada desde las pruebas neurocientíficas

Abstract

Se presenta una investigación de tipo cualitativa, de carácter documental y analítico. Se parte desde la perspectiva, que el dolor físico, cuando es evaluado en materia del derecho (prueba del dolor), se evalúa y analiza, desde un contenido de subjetividad; es por ello por lo que, se pretende dar un acercamiento en cómo mejorar la eficiencia de su evaluación (hacerlo más objetivo) a partir de otras herramientas que vayan más allá de la forma clásica en cómo se establecen las pericias, en este caso desde la mirada de las neurociencias, específicamente con el uso de las pruebas neurocientíficas (neurotecnológicas) existentes hoy en día. Es así como se plantea el acercamiento del derecho a las ciencias exactas, con el fin de plantear nuevos conceptos o propuestas que sumen al ordenamiento jurídico.
