
El presente artículo pretende brindar una solución al problema del daño moral, al presumir el perjuicio que plantea esta categoría, sin la presentación de un peritaje como medio probatorio, específicamente, vía informe psicológico. Para ello, pretendemos analizar y acreditar los perjuicios que acarrea sostener la teoría in re ipsa de este perjuicio no patrimonial. El objetivo de esta investigación es demostrar los perjuicios que acarrea la ausencia de uniformidad en la judicatura nacional respecto al criterio para determinar el monto por daño moral. Se trata de un estudio descriptivo en el que se empleó el método cualitativo. La población está constituida por el análisis de decisiones de la Corte Suprema de la República del Perú, específicamente casaciones de la Corte Suprema.
