Influencia de la declaración del menor en la determinación de la tenencia compartida

Abstract

El artículo analiza la repercusión de la declaración de los menores en los procesos de tenencia compartida en Perú, particularmente después de la promulgación de la Ley N° 31590. Esta normativa establece la tenencia compartida como la regla general, salvo que existan desacuerdos que puedan perjudicar al menor. Sin embargo, se ha identificado que su implementación podría vulnerar los derechos de los menores al no considerar situaciones específicas, como la violencia familiar. El principio del interés superior del niño se presenta como el eje central en estos procedimientos, exigiendo que los jueces prioricen el bienestar del menor al tomar decisiones. Se analizan diversos casos judiciales en los que la declaración del menor tuvo una incidencia significativa en las resoluciones, evidenciando cómo el testimonio, junto con los informes psicológicos y sociales, contribuye a decisiones más justas y adaptadas a cada situación particular. En este contexto, aunque la participación del menor es crucial, debe ser evaluada con cautela para evitar manipulaciones, como la alienación parental. La evaluación multidisciplinaria resulta fundamental para garantizar decisiones que protejan el bienestar emocional y el desarrollo integral del niño.
