Abstract

1/98 sayili Aile (Evlenme ve Bosanma) Yasasina gore, esler evlilik birliginin kurulmasiyla mallarinin yonetimi bakimindan, Yasanin onlar icin belirledigi mal rejimine tâbi olmaktadirlar. Yasada, ne eslere baska bir mal rejimi sekli secme olanagi taninmistir ne de eslerden birinin borca batik olmasi veya eslerden birinin surekli ayirt etme gucunden yoksun olmasi gibi eslerin malvarliklarini tehlikeye dusurebilecek olaganustu hallerde, eslerden birinin talebiyle ya da hâkim karariyla yasal mal rejiminin sonlandirilarak olaganustu mal rejiminin uygulanmasini saglayan bir hukme yer verilmistir. Aile Yasasinda duzenlenen mal rejiminde, evlilik birligi icinde edinilmis mallar ve kisisel mallar olmak uzere iki mal grubu vardir. Taraflarin evlilik suresince edindigi mallar paylasima tâbi iken, yasanin kisisel mal olarak tanimladigi mallar paylasima tâbi olmamaktadir. Mal paylasimi, taraflardan birine en az 1/3, en cok 2/3 oraninda mal kalacak sekilde yapilmalidir
