Abstract

La sentencia del Tribunal Supremo de 26 de enero de 2026 aborda el derecho a la devolución del tramo autonómico del Impuesto sobre Hidrocarburos tras su declaración de incompatibilidad con el Derecho de la Unión Europea. El litigio se origina por la contradicción entre el derogado artículo 50 ter de la Ley de Impuestos Especiales y el artículo 5 de la Directiva 2003/96/CE. A raíz de la sentencia del TJUE en el asunto DISA, el Tribunal Supremo reconoce que dicha normativa nacional no podía establecer tipos diferenciados por razón territorial. La resolución también analiza quién está legitimado para solicitar la devolución del ingreso indebido. En este sentido, distingue entre la repercusión jurídica del impuesto y la mera traslación económica del coste. La Sala de lo contencioso rechaza que la simple posibilidad de repercusión económica permita presumir un enriquecimiento injusto del solicitante. De este modo, la sentencia refuerza el principio de efectividad del Derecho de la Unión Europea en los procedimientos de devolución de tributos indebidos.
