Límites ético-legales en los sistemas de vigilancia: sistema de crédito social chino

Abstract

El presente estudio pretende tratar un tema de actualidad como son los algoritmos, el big data y las posibilidades que estos brindan a nuestra sociedad. Más concretamente se abordan los sistemas de control social existentes hoy en día. Por acotar aún más este trabajo analiza de manera completa y rigurosa el Sistema de Crédito Social Chino. En primer lugar, desarrolla su funcionamiento, consistente en la elaboración de una puntuación a través de información financiera y de carácter moral. Posteriormente se evalúan sus principales inconvenientes, sobre todo en relación con los límites legales y éticos que incumple: falta de privacidad y seguridad de los datos, excesivo control social, daños en la reputación y falta de transparencia. Finalmente, tiene como objetivo poner en contraste estos incumplimientos con las normas del ordenamiento jurídico español que entran en conflicto con el Sistema de Crédito Social implantado en China. De nuevo se pone el enfoque sobre aquellas intromisiones ilegítimas por parte del sistema en la intimidad y en la seguridad de los datos de la población china.
