Abstract

La sentencia del Tribunal de Justicia de la Unión Europea de 29 de abril de 2025, sobre el asunto C-453/23, arroja luz sobre uno de los temas más complejos existentes en la relación entre el concepto de ayuda de Estado en el sentido del artículo 107.1 del Tratado de Funcionamiento de la Unión Europea y las medidas tributarias: la selectividad de la medida. En concreto, entiende que una exención puede formar parte del «marco de referencia», indistintamente de su naturaleza, siempre y cuando no sea contraria al principio de no discriminación. Por lo tanto, dicho principio se consolida como la clave para la determinación de la selectividad de una medida tributaria en el ámbito de las ayudas de Estado en el sentido del artículo 107.1 del Tratado de Funcionamiento de la Unión Europea.
