Abstract

El aprovechamiento especial del dominio público permitido a través de la autorización de instalación y explotación de terrazas para el ejercicio en ellas de actividades de restauración en la vía pública no constituye un hecho imponible del Impuesto sobre Transmisiones Patrimoniales Onerosas, en aplicación de los artículos 7.1.B) y 13.2 del Impuesto sobre Transmisiones Patrimoniales y Actos Jurídicos Documentados. La regla especial contenida en este último artículo no supone una equiparación automática de las concesiones administrativas demaniales y las autorizaciones para el aprovechamiento especial de los bienes de dominio público, y debe interpretarse en el sentido de que solo resultaran gravadas estas últimas, si la intensidad del uso del dominio público es tal que origina un desplazamiento patrimonial a favor del autorizado equiparable materialmente a una concesión.
