El Tribunal Supremo ha desestimado varios recursos contencioso-administrativos planteados por los Ayuntamientos de Madrid, Salamanca, Valencia y Zaragoza contra el Acuerdo del Consejo de Ministros de 14 de noviembre de 2023 desestimatorio de las solicitudes de indemnización por responsabilidad patrimonial del Estado en relación con el IIVTNU fundadas en la Sentencia del Tribunal Constitucional 182/2021, de 26 de octubre, en relación con la inconstitucionalidad de los preceptos que lo regulaban en el Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales (TRLRHL).
