La pretendida exención del Impuesto sobre Bienes Inmuebles de los partidos políticos

Abstract

Con relación al régimen tributario propio de los partidos políticos, al que son acreedores por su especialísima naturaleza jurídica y por haberlo decidido así la Ley, surge la duda de si, entre las exenciones fiscales que se les otorgan, figura la relativa al Impuesto sobre Bienes Inmuebles, impuesto de titularidad municipal cuya exacción es obligatoria para los Ayuntamientos. La Ley Orgánica 8/2007, sobre financiación de los partidos políticos, no menciona ni tan siquiera a este impuesto al regular el régimen tributario propio de estos entes, pero, sin embargo, su remisión a la Ley 49/2002, de régimen fiscal de las entidades sin fines lucrativos, en lo no previsto en ella, hace surgir la duda de si se les aplican las exenciones previstas para las entidades no lucrativas, lo que de alguna manera supondría considerar a los partidos políticos como un tipo especial de aquellas. En este artículo se intentará desentrañar la cuestión de si los partidos políticos tienen derecho a gozar de la exención del IBI con relación a los inmuebles de los que son titulares.
