Abstract

En el presente asunto C-96/22 Companhia de Distribuição Integral Logista Portugal SA contra Autoridade Tributária e Aduaneira, el Supremo Tribunal de Portugal formula al Tribunal de Justicia una petición de decisión prejudicial relativa a la interpretación del artículo 34 TFUE y de los artículos 7 y 9 de la Directiva 2008/118/CE. En concreto, se plantea la cuestión relativa a si es compatible con la Directiva 2008/118 un régimen fiscal nacional en virtud del cual las cantidades de cigarrillos que superen el límite cuantitativo de despacho a consumo previsto en dicho régimen tributan al tipo impositivo vigente en una fecha posterior a la del despacho a consumo. La formulación clara e incondicional del artículo 7, apartado 1, de la Directiva 2008/118, así como la inexistencia de remisiones al Derecho de los Estados miembros, junto con la función central de esta disposición para realizar la finalidad armonizadora de la Directiva, abogan de forma clara en mi opinión, en favor de una interpretación según la cual esa disposición se opone a una norma nacional que establezca el devengo del impuesto especial en un momento distinto del despacho a consumo.
