Abstract

Trata la prueba de oficio como herramienta para alcanzar la verdad en el proceso judicial, salvaguardándose así la justicia material, evidenciando la prueba oficiosa hoy como un deber legal y constitucional del juez, que como director del proceso y mediante la sana crítica debe establecer en qué casos es necesario el decreto de esta prueba para remediar dudas determinantes para la decisión, dudas no resueltas por las partes a pesar de su trabajo diligente para arrimar los medios de prueba que respaldan sus afirmaciones o negaciones. El objetivo en este escrito es reflexionar acerca de la prueba de oficio como figura jurídica a través de la cual se logra en el caso concreto la protección de derechos. Primero, se describe brevemente a partir de la doctrina el concepto ´verdad procesal o judicial´; segundo, se realiza una aproximación doctrinal y jurisprudencial sobre el papel de la prueba de oficio en el proceso judicial; y por último, se describen casos resueltos en sede de revisión de tutela por la Corte Constitucional, en los que ante la omisión del decreto oficioso de la prueba resultó vulnerado el debido proceso. La metodología empleada se basó en la revisión documental y jurisprudencial.
