El Control Judicial de la Confiscatoriedad de las Normas Tributarias

Abstract

En la Argentina, las reglas del sistema federal de control de constitucionalidd de normas están definidas por la jurisprudencia. Dicha definición presneta, en ciertos ámbitos, algunos contornos disctubiles; uno de esos ámbitos es el control de la constitucionalidad de la confiscatoriedad de tributos. Entre los puntos a considerar están los siguientes: la fijación por parte de losjueces de un determinado "tope" a la presión tributaria; los efectos que tiene la declaración de inconstitucionalidad de una norma por razones de confiscatoriedad; la consideración de los factores extrafiscales de la norma. Todos ellos constituyen verdaderos desafíos para el razonamiento judicial, alque, por un lado se le exige permanecer al margen de las contingencias políticas y por otro se le pide compromiso con un ideario constitucional cada vez más complejo. Hacia el final del artículo, se vislumbra que la técnica de las sentencias "exhortativas" puede constituir un elemento interesante de superación de tales conflictos.
