Prospettive di riforma del bicameralismo in Italia

Abstract

La Costituzione italiana presenta oggi al suo interno una vistosa zona di sofferenza: il nuovo titolo V. Il suo (parziale e contraddittorio) incardinamento nel sistema è stato non a caso, in questi anni, accompagnato dagli incalzanti interventi della Corte costituzionale (che hanno, di fatto, contribuito a riscriverne profondamente i contenuti). A tale riguardo l’articolo affronta tre dei molteplici sintomi di questa tendenza: a) la scomparsa in Costituzione dell’interesse nazionale e di ogni riferimento al Mezzogiorno; b) l’introduzione del modello asimmetrico di relazioni Stato-Regioni (art. 116); c) il dissolvimento dell’unità dei diritti, sancita dalla lettera m) dell’art. 117 (frettolosamente soppiantata dalla filosofia degli standard minimi di prestazione). Di qui l’urgenza di (re)intervenire oggi sul titolo V per procedere ad una sua coerente e rinnovata revisione. Ed è proprio a partire da queste istanze che, da più parti, è recentemente venuta maturando l’esigenza di procedere, in tempi congrui, alla istituzione di una Camera territoriale, in grado di garantire una maggiore coesione all’interno dello Stato.
