[ES] La doctrina espa?ola escasamente se ha preocupado por el tema de los da?os que puedan ocasionarse entre s?, las personas unidas por v?nculos familiares, ya sean por matrimonio o parentesco, enti?ndase c?nyuges, padres e hijos, hermanos, entre otros, e incluso entre personas unidas por lazos de afectividad y convivencia, como es el caso de las uniones de hecho. En efecto, cualquier estudio bibliogr?fico, demuestra la efectividad de nuestra afirmaci?n, debido probablemente a que el Derecho de da?os se aviene mal con el Derecho de familia, en atenci?n a que ?ste ?ltimo est? inspirado en principios que exceden a cuestiones meramente patrimoniales, como son la jerarquizaci?n de la estructura familiar, el inter?s y bien com?n de la familia, la protecci?n superior del menor, la sacralizaci?n del matrimonio, v?nculos de solidaridad y altruismo, todos contrarios a la presentaci?n de cualquier reclamaci?n jur?dica entre las partes involucradas.
[EN] he Spanish doctrine has barely concerned about the issue of damages that may arise between them, the people united by family ties, whether by marriage or relationship, you understand spouses, parents and children, brothers, among others, and even among people united by ties of affection and fellowship, as is the case of partnerships. Indeed, any literature review demonstrates the effectiveness of our contention, probably because the law of torts agrees wrong with family law, having regard to the latter is inspired by principles that go beyond purely economic issues, such as the hierarchical family structure, interest and common good of family, protection of the child, the sacredness of marriage, bonds of solidarity and altruism, all contrary to the submission of any legal claims between the parties involved.
