En este trabajo se aborda el problema del activismo judicial y los límites de la jurisdicción desde el punto de vista de diferentes concepciones del Derecho (formalismo, normativismo, realismo, escepticismo crítico, iusnaturalismo, neoconstitucionalismo) tal como estas quedan a su vez clasificadas y criticadas desde la concepción argumentativa. El argumento central trata de mostrar de qué precisas maneras una visión post-positivista del Derecho conduce a ampliar o restringir los márgenes del activismo judicial justificado en un Estado constitucional respecto de lo que señalan las tesis distintivas de cada una de las anteriores concepciones.
