A pesar del extraordinario auge de la técnica de la ponderación de derechos en la jurisprudencia y en la doctrina, la relación entre el abuso del derecho y la ponderación apenas ha sido analizada. Esta nota tiene por objeto realizar una primera aproximación a esta relación, con el fin de delimitar los contornos y puntos de fricción entre ambos fenómenos.
