Comprensión trialista de la justificación de las decisiones judiciales

Abstract

1La justification des décisions judiciaires acquiert diverses significations en fonction de la compréhension de la signification qui est soutenue par rapport à ces décisions. Dans notre cas, nous devons la poser conformément à la théorie trialiste du monde juridique, élaborée fondamentalement par Werner Goldschmidt dans la conception tridimensionnelle du droit, qui affirme qu'il y a trois dimensions : la réalité sociale, les normes et les valeurs.

1La justificacion de las decisiones judiciales adquiere diversas significaciones segun la comprension del significado que se sostenga respecto de dichas decisiones. En nuestro caso, hemos de plantearla conforme a la teoria trialista del mundo juridico, elaborada basicamente por Werner Goldschmidt dentro de la concepcion tridimensional del Derecho, que afirma que en este hay tres dimensiones: realidad social, normas y valores.

1The justification of judicial decisions acquires different meanings according to the understanding of the meaning that is sustained with respect to said decisions. In our case, we must propose it according to the trialist theory of the legal world, basically elaborated by Werner Goldschmidt within the three-dimensional conception of Law, which affirms that there are three dimensions: social reality, norms and values.

1 يكتسب تبرير الأحكام القضائية معان مختلفة وفقًا لفهم المعنى الذي يتم الحفاظ عليه فيما يتعلق بالقرارات المذكورة. في حالتنا، يجب أن نقترحها وفقًا للنظرية التجريبية للعالم القانوني، التي وضعها بشكل أساسي فيرنر جولدشميت ضمن المفهوم ثلاثي الأبعاد للقانون، والذي يؤكد أن هناك ثلاثة أبعاد: الواقع الاجتماعي والمعايير والقيم.
