Costituzione come limite, Costituzione come fondamento, Costituzione come assiologia

Abstract

Intendo ricostruire ed esplorare tre modi di intendere la costituzione, e soprattutto la parte “sostanziale” della costituzione, quella che contiene la proclamazione dei principi e diritti fondamentali. Indicherò queste tre concezioni utilizzando rispettivamente le formule “costituzione come limite” (o modello della costituzione “per regole”), “costituzione come fondamento” (o modello della costituzione “per principi”), e “costituzione come assiologia” (o modello della costituzione “per valori”). Si tratta di una tripartizione che, a mia conoscenza, non è stata ancora impiegata in questi termini nelle ricerche di teoria costituzionale, anche se ovviamente rielabora alcuni spunti già presenti nella letteratura costituzionalistica e filosofico-giuridica. Si tratta, per l’appunto, di tre “modelli”, o tipi ideali: cioè di ricostruzioni necessariamente schematiche e semplificate di fenomeni che, nella realtà, si presentano in maniera inevitabilmente assai più disordinata e intrecciata di quanto l’analisi modellistica potrebbe a prima vista lasciar pensare
