DOI: 10.12957/rqi.2016.20809 Resumo Este estudo aborda os debates juridicos ocorridos na segunda metade do seculo XIX acerca da responsabilidade pelo exercicio do poder moderador. A partir de uma analise arqueologica da estrutura e do conteudo dos argumentos empregados, pretende-se compreender as regras que compoem a ordem discursiva no interior da qual o debate se desenvolve, e que presidiram o intricado processo de modernizacao do discurso juridico brasileiro apos a independencia. Ao final pode-se concluir que as divergencias entre os juristas do periodo nao sao apenas politicas ou hermeneuticas, mas refletem o contraste entre duas concepcoes distintas de ordem juridica: uma racional-realista, que enxerga o direito como conjunto de relacoes necessarias extraidas do espirito da ordem constitucional; e outra legal-formalista, que concebe o direito como conjunto de normas positivas formalizadas no texto da constituicao Palavras-chave : historia do direito constitucional; Constituicao de 1824; poder moderador; ordem do discurso juridico; modernizacao da ordem juridica brasileira. Abstract This study addresses the legal debates that took place in the second half of the nineteenth century about the legal responsibility of the moderating power. By doing an archaeological analysis of the structure and content of the arguments used, it aims to understand the rules that make up the discursive order within which the debate develops, and which have inspired the complex process of brazilian legal discourse modernization after the country’s independence. It concludes that differences among jurists of the period are not only political or hermeneutical, but also reflect the contrast between two different conceptions of law: a rational-realist one, which sees law as a set of necessary relationships drawn from the spirit of constitutional order; and a legal-formalist one, which sees law as a set of positive norms textually formalized on the constitution.
