Aceito em 12 de janeiro de 2016 DOI: 10.12957/rqi.2016.19983 Resumo Este trabalho tem por objetivo demonstrar que as procuradorias publicas nao se apresentam como orgaos do Poder Executivo, qualificando-se, em verdade, como orgaos de Estado,aqui considerado em sentido mais amplo. Para atingi-lo, parto do posicionamento da Advocacia Publica na organizacao do Estado Brasileiro e da especificacao das atribuicoes conferidas pelo constituinte a cada uma das instituicoes publicas que integram o rol das chamadas funcoes essenciais da justica, para discorrer sobre as dificuldades inerentes a designacao das procuradorias publicas como orgaos subordinados ao Poder Executivo e sobre a consequente necessidade da sua qualificacao como orgaos constitucionais de soberania. A confirmacao da tese segundo a qual a Advocacia Publica transcende a estrutura do Poder Executivo,para se configurar como orgao de Estado, refuta a ilacao (colhida da praxis juridica) de que seus integrantes estariam obrigados a procurar conferir aparencia de legalidade a opcoes politicas e administrativas preconcebidas pelos governantes e demais gestores publicos, e com isso confere maior efetividade ao controle interno da atividade administrativa Abstract This work aims to demonstrate that public prosecutors are not presented as organs of the executive power, qualifying, in fact, rather, as State bodies, considered in the broadest sense of the term. In furtherance of this,, the inception of Public Advocacy in the Brazilian state organization and the specification of powers conferred to it by each of the constituent public institutions that comprise the list of the so-called essential functions of justice, to discuss the inherent difficulties found in the appointment of public prosecutors as organs subordinate to the executive branch and the consequent need for their qualification as constitutional organs of sovereignty. The confirmation of the thesis according to which Public Advocacy transcends the structure of the executive branch, to be set up as an organ of the State, refutes the implication (harvested from legal praxis) that its members would be forced to seek the conference of the appearance of legality of the political and administrative options preconceived by those governing and other public officials, and thus provide more effective internal control of administrative activity.
