DOI: 10.12957/rqi.2016.19270 Resumo No presente artigo, temos por objetivo discutir a teoria dos custos dos direitos no âmbito dos direitos fundamentais. Segundo tal teoria, nao ha direitos se nao houver recursos materiais para sua promocao. Em um ambiente de escassez de recursos e de necessidades humanas ilimitadas, deve-se prezar pela adequada administracao e alocacao dos recursos disponiveis. Afirma-se, nessa teoria, que alguns direitos fundamentais, os individuais, nao geram custos para sua realizacao, de modo que a escassez de recursos impediria apenas a concretizacao de direitos sociais. No entanto, uma abordagem realista do Direito permite identificar que qualquer direito demanda custo, o que torna a teoria dos custos dos direitos refutavel ao se constatar que sua finalidade, antes de descrever o Direito, e subordina-lo a uma certa forma de organizacao social, promotora de alguns direitos fundamentais, mas nao de outros. Minimo Existencial Abstract This paper aims to discuss on the theory of the costs of rights with respect to fundamental rights. In accordance with this theory, there is no rights if it lacks the resources necessary for their promotion. In an environment of scarcity and of unlimited human needs, one should adequately manage the allocation of available resources. It is said, by this theory, that some fundamental rights, that is the individual rights, do not generate costs for being implemented, and thus the scarcity prevents from implementing social rights only. However, a realistic approach on Law identifies that any right needs resources for being effective, which refutes the theory of costs of rights because it becomes clear that the aim of such theory is not exactly to describe Law, but to subordinate it to a certain form of social organization that promotes certain rights but not others.
