Nao se trata de um trabalho simples. As exigencias basicas das pessoas e as situacoes da vida devem ser trazidos a consideracao – como foi a proposta da razao pratica – em um processo ascendente e franco. Um tipo de “espiral” argumentativa, nunca concluida e sempre guiada por uma ideia geral de justica concreta. Nisso consiste o desafio do seculo XXI ainda que, em definitivo, tenha sido o eterno desafio de todos os tempos. EnglishThis essay seeks to demonstrate that positivization human rights does not close any debate on the content and actual extent of any such rights. The discussion in the XXI century requires intellectual work organized around the development and guarantee the essential core of the rights of people, in the complex situations in which they operate. This is not a simple job. The basic requirements of the people and life situations must be brought to account - as was the proposal of practical reason - in an upward and frank process. A kind of "spiral" argumentative, never completed and always guided by an overview of practical justice. Therein lies the challenge of the XXI although, ultimately, it was the eternal challenge of all time century.
