Mediation is a flexible and voluntary method of resolving business disputes. Recently its unique characteristics have been utilized in disputes arising in the context of the enforcement of security interests. UNCITRAL Model Law on Secured Transactions has recognized the use of alternative dispute resolution mechanisms including mediation in the enforcement of security interests. This article examines key issues in the use of mediation in the enforcement of security interests including the effect of mediation on third parties.
