Abstract

In der politischen Diskussion wird die Umwelthaftung gemeinsam mit Abgaben/Steuern und Zertifikaten sowie freiwilligen Selbstverpflichtungsabkommen der Industrie zu den marktorientierten Instrumenten der Umweltpolitik gezahlt. Dabei wird vermutet, das eine Umwelthaftpflichtversicherung uber risikoabhangige Pramiendifferenzierungen das Verursacherprinzip starke und die Unternehmen zu einer groseren Sorgfalt motivieren konne.1 Neben der Verbesserung der Anspruchschancen potentiell Geschadigter ist die erhoffte Vorsorgewirkung ein wichtiges Motiv der Reform.2
