Kommunalpolitik in Hamburg

Abstract

Nach Artikel 1 der Hamburgischen Verfassung (im Weiteren: HV) ist Hamburg – der Praambel des Grundgesetzes folgend – ein Land der Bundesrepublik Deutschland. Darin spiegelt sich das Bekenntnis zum foderalen Aufbau der Bundesrepublik Deutschland wider. Das Land Hamburg besitzt – wie alle Lander Deutschlands – Staatsqualitat mit eigener, nicht vom Bund abgeleiteter, sondern von ihm lediglich anerkannter staatlicher Hoheitsmacht. Die Freie und Hansestadt Hamburg ist damit sowohl Stadt als auch Staat zugleich. Der Begriff Stadtstaat ist ein Rechtsbegriff, der in Gesetzen, nicht aber in der HV verwendet wird. In der staatsrechtlichen Literatur des Deutschen Reiches von 1871 kam der Terminus des Stadtstaates auf und fand fortan Anwendung fur die von den Freien Reichsstadten des Heiligen Romischen Reiches deutscher Nationen „ubriggebliebenen“ Hansestadte Lubeck, Bremen und Hamburg.
