Bu tez çalışmasında, Kelsen'in saf hukuk teorisi incelenmiş ve bu teorinin uluslararası insancıl hukuk ile ilişkisi irdelenmiştir. Kelsen'in saf hukuk teorisi, hukukun ne olduğunu ve nasıl olduğunu belirlemeyi amaçlayan bir yöntem ortaya koyar. Norm kavramını temel alan bu teoriye göre, hukuk normu Sollen (`olması gereken`) niteliğe sahip olmalı ve normlar hiyerarşisinde kendisinden üst kademede bulunan norma uygun olarak yaratılmış olmalıdır. Uluslararası insancıl hukuk normlarının nasıl ortaya çıktığı incelendiğinde, bu normların silahlı çatışmalardaki yıkımların ve acıların en aza indirgenmesi ve tüm insanların mümkün olan en yüksek düzeyde korunması kaygısı ışığında yaratıldığı ve bu doğrultudaki değerlerden bağımsız düşünülemeyeceği görülür. Dolayısıyla uluslararası insancıl hukuk normları, saf normatif yöntemle yaratılma şartını sağlamamaktadır. Uluslararası insancıl hukuk normlarına aykırı davranışların tamamının yaptırım ile karşılık görmemesi de bu normların sistematik olarak Sollen niteliğe sahip olmadığı anlamına gelir.

This thesis examines Kelsen's pure theory of law and its relationship with international humanitarian law. Kelsen's pure theory of law presents a method which aims to determine what and how law is. According to this theory that is based on the concept of norm, a legal norm shall have the characteristic of Sollen (`shall`) and shall be enacted in conformity with the norm that stands at a higher level in the hierarchy of norms. The norms of international humanitarian law are enacted with the purpose of minimizing the destruction and suffering in the armed conflicts and providing the highest protection for all people. Since the creation of these norms cannot be detached from the ideas and values in line with their purpose, they do not fulfill the condition of being enacted by the pure normative method. International humanitarian law does not provide sanctions for all behaviors violating its norms, and this means that the norms of international humanitarian law do not systematically have the characteristic of Sollen.
