
The article is devoted to theoretical-legislative analysis of the activity of the organs of self-organization of population as the form of demonstrative democracy in Ukraine in the context of their interaction with the organs of local government.The survey of the current legislation of Ukraine which regulates the activities of community organizations was carried out. They are the Constitution of Ukraine, the Law of Ukraine “About the Local Autonomy in Ukraine” and the Law of Ukraine “About Self-organization of Population” as for the questions of participation of the organs of local legislature in the processes of organization and legalization of the organs of self-organization of population it is pointed out that the statutes of the territory community express the democratic beginning of the self-organization of Ukraine more fully.The problems and tasks, the own and delegated powers of the respective parliament, the principles of acting of the organs of self-organization of population are considered and it is seen that they play a very special role in the foundation of the community. The gaps and contradictions in the current legislation of Ukraine are pointed out, which make proposals to eliminate them through local rulemaking.On the basis of the Law of Ukraine "On Associations of Owners of Apartment Buildings" the concept of "Unification of Owners of Apartment Buildings" was analyzed. The concept represents the interest of the dwellers of these houses. The features about origin and purpose of those two similar on the first sight forms of the self-organization of population were pointed out. So the conclusions about the need of active interaction between the owners of the apartment buildings and organs of self-organization of the population were carried out. The common aim is to make the quality of life better on the particular territory.Besides, the whole politics of the organs of self-organization of population and the politics of the local government must be based on the smallest interaction in the activities of each other.
В статье проведен обзор действующего законодательства Украины, регулирующего деятельность органов самоорганизации населения как одного из важных элементов системы органов местного самоуправления, максимально приближенных к жителям и поэтому хорошо владеющих информацией, связанной с повседневными проблемами общины.Осуществлен анализ нормативных положений относительно задач, полномочий и принципов деятельности органов самоорганизации населения в контексте их взаимодействия с органами местного самоуправления. Отмечено, что устранить противоречия и пробелы в действующем законодательстве Украины в отношении органов самоорганизации населения возможно только путем проведения локального нормотворчества.Особое место занимает вопрос о соотношении статуса органов самоорганизации населения и объединений собственников многоквартирных домов. Сформулированы выводы о необходимости их активного сотрудничества в рамках соответствующей территории.
Статтю присвячено аналізу діяльності органів самоорганізації населення як складової місцевого самоврядування України. Визначено особливості функціонування органів самоорганізації населення поряд з існуванням інших громадських структур в контексті виконання власних і делегованих повноважень, а також визначені перспективи удосконалення їх діяльності.
