ЕКОНОМІЧНІ САНКЦІЇ ЯК ОБСТАВИНИ НЕПЕРЕБОРНОЇ СИЛИ

Abstract

The article discusses foreign economic sanctions through the prism of a comparative legal analysis of approaches to force majeure implemented in various legal systems, private international law for the possible recognition of restriction in international trade as circumstances that exempt from liability for breach of contractual obligations. Based on an analysis of the attributes of economic sanctions, it is concluded that the legal impossibility of fulfilling contractual obligations as a result of the introduction of sanctions can be attributed, by agreement of the parties, to force majeure circumstances that relieve the responsible party from liability.

В статье рассматриваются внешнеэкономические санкции сквозь призму сравнительно-правового анализа реализованных в различных правовых системах, международном частном праве подходов к непреодолимой силе на предмет возможного признания рестрикций в международной торговле в качестве обстоятельств, освобождающих от ответственности за нарушение договорных обязательств. На основании анализа атрибутов экономических санкций делается вывод, что юридическая невозможность выполнения договорных обязательств вследствие внедрения санкций может быть отнесена по согласованию сторон к форс-мажорным обстоятельствам, освобождающим неисправную сторону от ответственности.

В статті розглядаються зовнішньоекономічні санкції крізь призму порівняльно-правового аналізу реалізованих у різних правових системах, міжнародному приватному праві підходів до непереборної сили на предмет можливого визнання рестрикцій в міжнародній торгівлі як обставин, що звільняють від відповідальності за порушення договірних зобов’язань.
