The article is devoted to a comprehensive scientific study of the current state of administrative and legal regulation of the «green» economy in ensuring the economic stability of Ukraine by revealing its essence and, accordingly, establishing certain features. Some scientific approaches to defining the concept of the «green» economy of the state are considered, and based on their analysis, one’s own opinion is expressed regarding the interpretation of this concept. It is stated that as of today, administrative and legal regulation of the «green» economy in Ukraine is carried out in accordance with the provisions of a set of certain documents aimed at ensuring environmentally balanced economic development of the state. The author’s vision is expressed regarding the disclosure of the essence of the concept of administrative and legal regulation of the «green» economy of the state, under which it is proposed to consider a set of administrative and legal norms and mechanisms aimed at integrating the principles of sustainable development and environmental protection into the economic policy of the country. The main characteristics of the administrative and legal regulation of the «green» economy of the state are highlighted, namely: integration of environmental standards into the national legal system by including environmental requirements and standards in regulatory legal acts regulating economic processes; stimulation of «green» investments and innovations, which requires the development and implementation of relevant legal norms in order to stimulate investment in environmentally friendly technologies and the development of «green» sectors of the economy; coordination between public and private institutions, which involves interaction between public authorities and the private sector to ensure the effective implementation of «green» initiatives; development of legal infrastructure in order to build legal mechanisms that contribute to the development of the «green» economy; provision of control and supervision mechanisms, which is achieved by creating effective mechanisms of state control and supervision over the implementation of environmental norms and standards, etc.

Статтю присвячено комплексному науковому дослідженню сучасного стану адміністративно-правового регулювання «зеленої економіки» у забезпеченні економічної стійкості України шляхом розкриття його сутності та відповідно встановлення певних особливостей. Розглянуто деякі наукові підходи щодо визначення поняття «зеленої» економіки держави, на підставі їх аналізу висловлено власну думку щодо трактування цього поняття. Констатовано, що станом на сьогодні адміністративно-правове регулювання «зеленої» економіки в Україні здійснюється у відповідності до положень сукупності певних документів, спрямованих на забезпечення екологічно збалансованого економічного розвитку держави. Висловлено авторське бачення щодо розкриття сутності поняття адміністративно-правового регулювання «зеленої» економіки держави, під яким запропоновано вважати сукупність адміністративно-правових норм і механізмів, спрямованих на інтеграцію принципів сталого розвитку та охорони навколишнього середовища в економічну політику країни. Виділено основні характеристики адміністративно-правового регулювання «зеленої» економіки держави, а саме: інтеграція екологічних стандартів у національну правову систему шляхом включення екологічних вимог і стандартів у нормативно-правові акти, що регулюють економічні процеси; стимулювання «зелених» інвестицій та інновацій, що вимагає розробки та впровадження відповідних правових норм з метою стимулювання інвестицій в екологічно чисті технології та розвиток «зелених» секторів економіки; координація між державними та приватними інститутами, що передбачає взаємодію між державними органами та приватним сектором забезпечення ефективного впровадження «зелених» ініціатив; розвиток правової інфраструктури з метою розбудови правових механізмів, які сприяють розвитку «зеленої» економіки; забезпечення механізмів контролю та нагляду, що досягається шляхом створення ефективних механізмів державного контролю та нагляду за реалізацією екологічних норм і стандартів тощо.
